The agreement between a program and HubiCare for use of the service, and the rules for every user.

Who this is for

These terms are between HubiCare LLC ("HubiCare", "we") and the organization that opens a HubiCare account (the "program"). They take effect on October 31, 2026 or when the program's order form is signed, whichever is later. Staff and family users are bound by the "Rules for every user" section.

HubiCare has no public self-signup. Accounts are opened by HubiCare after a quote. The program's owner accepts these terms in HubiCare at first sign-in, and some programs also sign an order form. Pricing is by quote only.

The service

HubiCare provides the software described in the order form: attendance and door tablet, children's and staff records, family app and messaging, billing (with online payments through Stripe when the program turns them on), enrollment, compliance files and reports, with optional AI features that the program turns on itself.

HubiCare is a tool. The program remains responsible for its own licensing, ratios, record keeping, reporting to agencies, and the accuracy of what its staff and families enter. HubiCare does not file anything with a government agency on the program's behalf.

Accounts and security

  • The program names an owner who manages its account and accepts these terms on its behalf. HubiCare records who accepted, when and which version.
  • Each person gets their own login. Logins are not shared. Owners, site administrators and billing users must use two-step verification.
  • The program removes access for staff who leave, the same day where possible.
  • The program tells HubiCare at security@hubicare.app as soon as it suspects a login or device has been compromised.

Data

  • The program owns its data. HubiCare processes it only to provide the service, as described in the Privacy Policy and, for schools, the Student Data / FERPA notice and the Data Processing Agreement.
  • HubiCare does not sell data and does not use it for advertising.
  • Take your data with you: the program's owner can download all of the program's data at any time, with no fee and no need to ask us. The owner asks for a full export in Settings, Your data, confirming with a fresh two-step code. It is prepared in the background as a ZIP of spreadsheets (CSV), documents and photos, with a README and a checksum list. It contains sensitive information about children, including health details, so it must be kept private. HubiCare keeps the file in private storage, readable only by the program's owners when signed in with two-step verification, for 7 days, then deletes it automatically. Every request and download is recorded in the audit log and the program's other owners are notified. The export includes a change history (who changed what, and when); the full technical log, with before and after values, is kept by HubiCare and given to the program on request. One full export runs at a time, up to 3 a day.
  • On termination the program can export its data; HubiCare deletes it within 90 days unless a law requires keeping it (see Records Retention).
  • The program is responsible for obtaining the consents it needs from families, including for photos and for AI features it turns on.

Fees and payment

Fees are in the order form. Invoices are due in 30 days unless the order form says otherwise. HubiCare may suspend an account that is more than 60 days overdue after written notice, and will not delete data during a suspension. Family payments collected through Stripe are between the program and the family; Stripe's fees are disclosed in the order form.

Rules for every user

  • Use HubiCare only for the program's legitimate operations.
  • Do not try to reach another program's or family's data, test security without written permission, or interfere with the service.
  • Do not upload anything unlawful, or content you do not have the right to share.
  • Do not share your login or the door tablet's pairing with anyone.

HubiCare may suspend a user who breaks these rules and will tell the program.

Availability and support

HubiCare aims for 99.9% monthly availability for the web app, excluding announced maintenance. Current status is at /status. Support contacts are listed under Contact below. The door tablet keeps working offline and syncs when the connection returns.

Warranties and limits

HubiCare will provide the service with reasonable skill and care and keep the security measures described on the Security overview page. Except as stated here, the service is provided as is. To the extent allowed by law, HubiCare's total liability under these terms is limited to the fees paid in the 12 months before the claim, except for breaches of confidentiality, data protection obligations or a party's gross negligence or willful misconduct. Neither party is liable for indirect or consequential loss.

Term and termination

The term is in the order form. Either party may end the agreement for a material breach that is not fixed within 30 days of written notice. The program may export its data at any time before the end of the term and for 30 days after.

Changes

HubiCare may update these terms with 30 days' notice by email to the program owner. Changes that reduce the program's rights do not apply to a prepaid term without the program's agreement.

Law and disputes

These terms are governed by the laws of the State of Minnesota, with exclusive venue in the state and federal courts located in Hennepin County, Minnesota. The parties try to resolve disputes by talking first, then by mediation, before going to court. Nothing here limits a public school's rights or duties under Minnesota law.
