How HubiCare handles information about children under 13, and how COPPA applies.
The short version
Children do not use HubiCare and do not have accounts. Adults (program staff, parents and guardians) enter and view information about children. HubiCare never knowingly collects personal information directly from a child under 13.
What information about children HubiCare holds
- Identity and enrollment: name, date of birth, program, schedule, classroom.
- Household: parents, guardians, emergency contacts and authorized pickup adults (with a photo of the adult if the program adds one with the adult's agreement).
- Attendance: sign-in and sign-out times, and who brought and collected the child.
- Health: allergies, medications, conditions, immunizations and incident reports. The whole database is encrypted at rest; medical conditions and immunization exemptions are also encrypted with a separate key.
- Daily reports and learning observations.
- Photos: sharing children's photos with families and children's profile pictures are turned off for every program for now. Photos already stored are kept but are not shown to families. If HubiCare turns these features on again, photos are used only where the family has given the program consent for photos.
This information is entered by the program or by a parent or guardian. It is used only to run the program's service to that family.
COPPA
The Children's Online Privacy Protection Act (COPPA) and the FTC's COPPA Rule (16 CFR Part 312, as amended effective June 23, 2025) govern online services that collect personal information from children under 13. HubiCare is a service for adults and is not directed to children. Where COPPA applies because a program lets a child use a HubiCare feature directly, HubiCare relies on one of two paths:
- Parental consent obtained by the program from the parent or guardian, recorded in HubiCare.
- School authorization: under long-standing FTC guidance, a school (or school district) may consent on parents' behalf for an education technology service used solely for the school's educational purpose, where the provider does not use the information for any commercial purpose. HubiCare meets this condition: no advertising, no sale of data, no profiling, no use beyond the school's instructions. The 2025 COPPA amendments did not codify this exception, so it rests on FTC guidance; schools remain free to require parental consent instead.
Biometric identifiers count as personal information under the amended Rule. HubiCare does not collect fingerprints, face templates or voice prints. Photos of pickup adults are plain photos shown to staff, not biometric templates. Voice messages are turned off for every program for now.
What parents and guardians can do
- Review the information held about their child, through the family app and by asking the program for a download of the child's record and any other records it holds.
- Ask the program to correct or delete it. Where no law requires keeping the record (for example, Minnesota CCAP attendance rules), the program has HubiCare delete it; otherwise it says what is kept and why.
- Refuse to consent to photos, or withdraw consent at any time, without losing the rest of the service.
- Choose which notifications they receive and in which language.
No marketing to children or families
HubiCare shows no advertising, sends no marketing to families and does not share children's information with advertisers or data brokers.
